/poll

Start a new Discord poll. Required parameters are:

• Question: The topic to be discussed.
• Answers: The list of possible answers to your question, separated by a comma “,”
• Expiration: The expiration time for the poll, passed with the following format: [hh:mm] (Hours and minutes separated by columns “:”)

/stop

Stops the current poll, without waiting for the expiration time

/cancel

Cancels the current poll

/role

Sets the preference for a specified role. Required parameters are:

• Ruolo: The mention to the role you want to edit.
• Allowed: Wheter the role is allowed to vote. Optional parameters are:
• Multiplier: the multiplier assigned to that role. If no roles are specified, @everyone is allowed to vote and the multiplier is set to 1. If some role are specified, only specified roles with allowed set to “True” are allowed to vote. Unspecified roles will not be allowed to vote.

/roles

Sends a message with all the preferences specified for every role in your server.

/embed

Edit the poll embed’s appearance. Required parameters are:

• Nome: The title of the embed. Optional parameters are:
• Image: Embed’s image URL
• Color: Embed’s color (can be its name like “Yellow” or its hex code like “#FFFF00”)

Please read this end user license agreement carefully. This End User License Agreement (“EULA”) governs your use of the Votex Discord Bot (the “Bot”). This EULA sets out the basis on which Ziken Labs makes the Bot available to you (“user” or ”you”) and on which you may use the Bot. Ziken Labs’s Privacy Policy forms an integral part of this EULA. By installing or using the Bot, you agree to accept and to be bound by (1) this EULA and (2) the Privacy Policy at all times. If you do not agree with one of these, please do not install or use the Bot. 

1. About Us

5. Our Privacy Policy equally applies to these Terms and forms an integral part of these Terms.

2. Grant of License

1. Ziken Labs grants you a non-exclusive, non-transferable, non-sublicensed, non-commercial and personal license to install and/or use the Bot (the “License”), for such time until either you or Ziken Labs terminates this EULA. 
2. You must in no event use, nor allow others to use, the Bot or this License for commercial purposes without obtaining a license to do so from Ziken Labs. 
3. Updates, upgrades, patches and modifications may be necessary in order to be able to continue to use the Bot on certain hardware. This bot is licensed to you, not sold or gifted. 
4. While using the Bot, you agree to comply with all applicable laws, rules and regulations. In all cases, you may only use the Bot according to anticipated use of the Bot.
5. You shall not, directly or indirectly: 

1. 1. sell, rent out, lease, license, distribute, market, exploit the Bot or any of its parts commercially;
   2. reverse engineer, decompile, disassemble, adapt, reproduce, or create derivative works of this Bot, in whole or in part; 
   3. create, use and/or distribute “auto”,“script” or “macro” computer programs or other “hack” programs or software applications for this Bot; 
   4. remove, alter, disable or circumvent any copyright indications or other authorship and origin information, notices or labels contained on or within this Bot; and 
   5. export or re-export this Bot or any copy of adaptation in violation of any applicable laws or regulations.

3. Ownership

1. All title, ownership rights and intellectual property rights in and to the Bot (including, without limitation, all text, graphics and any other elements which are part of the Bot, individually or in combination) and any and all copies thereof are owned by Ziken Labs. 
2. The Bot is protected by national and international laws, copyright treaties and conventions and other laws. 
3. This Bot may contain certain licensed materials and, in that event, Ziken Labs’s licensors may protect their rights in the event of any violation of this Agreement. Any reproduction or representation of these licensed materials in any way and for any reason is prohibited without Ziken Labs’s prior permission and, if applicable, Ziken Labs’s licensors’ and representatives’. 
4. Except as expressly set forth in this EULA, all rights not granted hereunder to you are expressly reserved by Ziken Labs.
5. This License confers no title or ownership in the Bot and should not be construed as a sale of any rights in the Bot.

4. Collection of Personal Data

In order to provide you with a better experience, adapted services and Bot support, Ziken Labs may collect and store data about you in relation to your use of the Bot. Your privacy is very important to Ziken Labs. For further information concerning Ziken Labs’s use of your personal data, please refer to the Privacy Policy.

5. Warranty Disclaimer, Limitation of Liability

1. You expressly acknowledge that use of the Bot is at your own risk. To the fullest extent permissible under applicable law, the Bot is supplied on an “as is” And “as available“ basis. Ziken Labs, Ziken Labs’s licensors, channel partners and associated service providers do not make and hereby disclaim any guarantees, conditions, warranties of any kind, express, implied or statutory or other terms including as to: (a) its conformity, accuracy, currentness, completeness, reliability or security (b) its suitability for a particular use; (c) implied warranties of title, non-infringement; (d) its market value; or (e) your satisfaction. Ziken Labs does not warrant that the Bot will be uninterrupted or error-free, that defects will be corrected, or that the Bot is free of viruses or other harmful components. you assume all responsibility for selecting the Bot to achieve your intended results, and for the installation of, use of, and results obtained from the Bot.
2. To the fullest extent permissible under applicable law, in no event will Ziken Labs, Ziken Labs’s licensors, channel partners and associated service providers be liable for loss or damage suffered in connection with the use of the Bot or any related third party service. This includes without limitation: (a) all losses of any kind, whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation (whether innocent or negligent) or otherwise, (b) direct loss; (c) accidental loss, (d) incidental loss, (e) consequential loss, and (f) indirect loss.
3. Notwithstanding the aforementioned limitations of liability, your sole remedy in the event of a dispute with Ziken Labs or its licensors, channel partners and associated service providers is to cease to use the Bot; and if applicable, seek damages for your losses. In no event will Ziken Labs, its affiliates, licensors, channel partners and associated service providers be liable for damages in excess of any amount you have paid to Ziken Labs for the Bot during the twelve (12) months immediately prior to the time your cause of action arose.
4. Nothing in this section shall affect Ziken Labs’s liability for death or personal injury arising from Ziken Labs’s negligence, for fraud or fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.
5. For purposes of this section Ziken Labs’s licensors, channel partners and associated service providers are third party beneficiaries to the limitations of liability specified herein and they may enforce this EULA against you.

6. Indemnity

1. You are solely responsible for any damage caused to Ziken Labs, its licensors, channel partners and associated service providers and subcontractors, other users of the Bot or any other individual or legal entity as a result of your violation of this EULA.
2. You hereby agree to defend, indemnify and keep indemnified Ziken Labs and its affiliates, their licensors, channel partners and associated service providers and their subcontractors against any claim or alleged claims, liabilities, losses damages and all costs (including legal fees), directly or indirectly attributable to your fault and/or resulting from: (a) a violation of any provision of this EULA or (b) your use or misuse of the Bot. Ziken Labs reserves the right to take sole responsibility, at its own expense, for conducting the defense of any claim for which you agreed to indemnify Ziken Labs. The provisions of this Clause shall remain in force after termination of this EULA.

7. Termination

The EULA is effective from the earlier of the date you use the Bot, until terminated according to its terms. you and Ziken Labs may terminate this EULA, at any time, for any reason. Termination by Ziken Labs will be effective upon: (a) notice to you or (b) termination of your Ziken Labs Account (if any) or (c) at the time of Ziken Labs’s decision to discontinue offering and/or supporting the Bot. This EULA will terminate automatically if you fail to comply with any of the terms and conditions of this EULA. Upon termination for any reason, you must immediately uninstall the Bot and destroy all copies of the Bot in your possession.

8. Changes to this EULA or the bot

1. Ziken Labs reserves the right, in its sole and absolute discretion, to revise, update, change, modify, add to, supplement, or delete certain terms of this EULA for security, legal, best practice or regulatory reasons. Such changes will be effective with or, as applicable, without prior notice to you. you are responsible for checking this EULA periodically for changes. 
2. If any future changes to this EULA are unacceptable to you or cause you to no longer be in agreement or compliance with this EULA, you may terminate this EULA and must immediately uninstall the Bot and destroy all copies of the Bot. your continued use of the Bot following any revision to this EULA constitutes your complete and irrevocable acceptance of any and all such changes.
3. Ziken Labs may modify the Bot for any reason or without any specific reason, at any time and at its entire discretion, in particular for technical reasons such as updates, maintenance operations and/or resets to improve and/or optimize the Bot. 
4. You agree that the Bot may install or download the modifications automatically. 
5. You agree that Ziken Labs may stop supporting previous versions of the Bot upon availability of an updated version. Ziken Labs’s channel partners and associated service providers shall have no obligation to furnish any maintenance or customer support with respect to the Bot. Ziken Labs also reserves the right to amend the Rules of Conduct set out to place limits on the use of the Bot.

9. Other important Terms

3. This EULA and any document expressly referred to in it constitutes the entire agreement between us regarding their subject matter, and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to that subject matter. You agree that you shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or any document expressly referred to in it. You agree that you shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in these terms and conditions or any document expressly referred to in it.
4. Ciascuna delle condizioni di questi termini e condizioni opera separatamente. Se un tribunale o un'autorità competente decide che una di esse è illegale o inapplicabile, le restanti condizioni rimarranno pienamente valide ed efficaci. 
5. This EULA, its subject matter and its formation, and any other disputes or claims in connection therewith, are governed by the laws of Italy. In the event of any such disputes or claims in connection with these terms and conditions, you agree to first engage in good faith discussions with us to resolve such disputes or claims. If such dispute or claim is not resolved within sixty (60) days, we both irrevocably submit to the exclusive jurisdiction of the courts of Rome.

This privacy policy sets out the basis on which we will process any Personal Data that we may collect about you as a user of Votex Bot. This policy further sets out how we protect your privacy and your rights in respect of our use of your Personal Data. 

First of all, we would like to point out that this policy does not replace Discord`s Privacy Policy. Equally, and depending on your use of Votex Bot, you may be required to disclose your use of Votex Bot and Ziken Labs as your processor in your privacy policy and/or data processing agreement.

1. Who is the data controller?

A “data controller” is a person or organization who alone or jointly determines the purposes for which, and the manner in which, any Personal Data is, or is likely to be, processed. 2. What is personal data?

4. What are the legal bases for processing personal data?

Tutti i Dati Personali che otteniamo da te tramite il nostro sito web saranno trattati esclusivamente per le finalità descritte più dettagliatamente di seguito. Ciò avviene nell'ambito del DPC e del GDPR e solo se si applica almeno una delle seguenti condizioni: a) hai prestato il tuo consenso, b) i dati sono necessari per l'adempimento di un contratto / misure precontrattuali, c) i dati sono necessari per l'adempimento di un obbligo legale, oppure d) i dati sono necessari per tutelare i legittimi interessi della nostra azienda, a condizione che i tuoi interessi non vengano ignorati. 

5. What personal data do we collect from you?

Potremmo raccogliere ed elaborare i seguenti Dati Personali su di te:

a) Accessing the Discord platform and adding Votex Bot

Votex Bot can be added to a Discord Server, a service offered by Discord (Schiphol Boulevard 195, 1118 BG Schiphol, Netherlands). Accessing the Discord platform and using the features may require prior registration with Discord and/or installation of respective software.

b) Contacting Us

We offer you the opportunity to contact us using various methods. We collect the data you submit such as your name, Discord username, email address, telephone number and your message in order to process your enquiry and respond to you. The legal basis is both your consent and contract.

c) Contracting with us 

The protection of your data is particularly important to us in the performance of our contractual services. We therefore only want to process as much Personal Data (for example, your name, Discord username, email address) as is absolutely necessary. Nevertheless, we rely on the processing of certain Personal Data, to fulfill our contractual obligations to you or to carry out pre-contractual measures. 

d) Using Votex Bot

As mentioned above, we process the Personal Data or Special Category Data or Non-personal Data involved in your use of Votex Bot (“Service Data”) on your behalf (as your Data Processor). Depending on how you use Votex Bot, you may add admins, roles and polls and provide and/or request Service Data and we only use your Service Data for the purpose of providing you access to and use the features of Votex Bot. 

Also, we recognize that you own your Service Data and we provide you with complete control of your Service Data by providing you the ability to (i) access your Service Data, (ii) share your Service Data through supported third-party integrations, and (iii) request export or deletion of your Service Data. 

We also ensure that access by our employees to your data is only available on a need-to-know basis, restricted to specific individuals, and is logged and audited. We communicate our privacy and security guidelines to our employees and enforce privacy and protection safeguards strictly.

For the purpose of providing Votex Bot, all Service Data processed by us will be stored on a Vultr server (The Constant Company, LLC, 319 Clematis St Suite 900 West Palm Beach, Florida 33401 USA). We take appropriate legal precautions and corresponding technical and organizational measures to ensure the protection of your Service Data. 

e) Your end users and admins

When you design, integrate and configure admins, roles and polls we may also process Personal Data of your end users and admins. The data processed also falls under the above-mentioned Service Data category, however it is your responsibility to ensure that a) you have in place all necessary appropriate consents to allow for the lawful processing by us and b) you have provided your end users and admins with adequate privacy policies. You agree to indemnify us in relation to all and any liabilities, penalties, fines, awards, or costs arising from your non-compliance with these requirements.

Lastly, you understand that some jurisdictions may require you to disclose your use of Votex Bot and our Services as your processor in your privacy policy and/or data processing agreement as applicable.

f) Support ticket

If you create a support ticket, we will request Personal Data and, where applicable, non-Personal Data in accordance with your request, this may include your name, email address and other order related data you voluntarily provide. The data provided is not shared with third parties and cannot read your data when it is entered. If you submit a support ticket, we process the data for the purpose of processing and handling your ticket. 

Our employees will also have access to data that you knowingly share with us for technical support or to import data into our services. We communicate our privacy and security guidelines to our employees and enforce privacy safeguards strictly. The legal basis of the data processing is our obligation to fulfill the contract and/or our legitimate interest in processing your support ticket.

6. Disclosures of your data

We will not disclose or otherwise distribute your Personal Data and Service Data to third parties unless lawfully required to do so.

7. How long do we keep your personal data?

We process and store your Personal Data and Service Data only for the period of time required to achieve the respective processing purpose or for as long as a legal retention period exists. Once the purpose has been achieved or the retention period has expired, the corresponding data is routinely deleted.

8. How we secure your personal data

Se non saremo in grado di rispondere alla tua richiesta entro trenta (30) giorni, ti diremo perché e quando saremo in grado di rispondere alla tua richiesta. Se non siamo in grado di fornirti alcun Dato Personale o di apportare una correzione da te richiesta, ti diremo perché.

d) Complaint to a supervisory authority

L'autorità di controllo in Italia è il Garante italiano per la protezione dei dati personali, Piazza Venezia 11, 00187 Roma, (www.garanteprivacy.it). Tuttavia, apprezzeremmo l'opportunità di rispondere alle tue preoccupazioni prima di contattare il Garante per la protezione dei dati personali o qualsiasi altra autorità di controllo.

e) What we do not do

• Non richiediamo Dati Personali a minori e bambini;
